Who May Petition

State's Attorney or two LEOs (after investigation). A family or household member, and medical professional (results in order for investigation, and LEO or State's attorney must petition for order.)

Burden of proof for Emergency Order or Ex Parte Order

Good faith belief that respondent poses a risk of imminent personal injury to himself or herself or to another person. 

Notice and Opportunity

No later that 14 days after service
