Burden of proof for Emergency Order or Ex Parte Order

probable cause to believe that the respondent poses a significant danger of causing bodily injury to self or others by having possession or control of, purchasing, or receiving any firearm or ammunition. 

Notice and Opportunity

Court sets hearing date within 14 days and includes it in ex parte order if one is issued

What is Prohibited?

Possession or control of, purchasing, or receiving any firearm, ammunition, registration certificate, license to carry a concealed pistol, or dealer's license

Relinquish Firearms

Respondent is ordered to  surrender firearms, ammunition, registration certificates, licenses to carry a concealed pistol, or dealer's licenses in the respondent's possession, control, or ownership.

Seizure by LEA

LEO can take possession at the time of service of firearms voluntarily surrendered or discovered in a lawful search. Court may issue search warrant at same time as ERPO.

Preponderance of the evidence that the respondent poses a significant danger of causing bodily injury to self or others by having possession or control of, purchasing, or receiving any firearm or ammunition.
